Terms of Service

Effective: May 2026 | Big Mouth Marketing Pte Ltd

1. Acceptance of Terms

By accessing or using Leadber ("Service"), operated by Big Mouth Marketing Pte Ltd, you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Use of Service

Leadber is an AI-powered B2B lead discovery and outreach platform. Leadber acts solely as a data intermediary — sourcing publicly available business contact information and making it accessible to you for lawful B2B marketing purposes. Leadber does not own, control, or guarantee the accuracy of third-party business data.

You may use the Service only for lawful B2B marketing purposes. You must:

  • Only contact business entities and their representatives
  • Immediately honour any opt-out or STOP request
  • Comply with all applicable anti-spam and data protection laws
  • Not use the Service to send unsolicited personal marketing (B2C spam)
  • Not attempt to scrape competitor platforms through the Service

3. Credit System

Access to the Service is governed by a credit-based system. Each credit has a reference value of $0.01 USD. Credits are consumed per search, enrichment, or outreach action.

  • Credits are non-refundable except in the case of a failed LeadDive™ report where no data was returned
  • Unused monthly plan credits expire at the end of each billing cycle
  • Top-up (purchased) credits expire 12 months from purchase
  • Failed LeadDive™ dives (no data returned) are automatically refunded to your credit balance

4. Data & Privacy — Your Responsibility

All customer data is stored on our cloud infrastructure in Singapore. Leadber is designed to assist compliance with PDPA, GDPR, and Vietnam Decree 13/2023/ND-CP, but compliance is your sole responsibility.

You are the data controller for all lead data you access through the Service. You must:

  • Check applicable Do Not Call (DNC) registries before contacting any individual
  • Obtain proper consent where required by local data protection laws
  • Honor all opt-out and unsubscribe requests immediately
  • Maintain consent records as required by applicable regulations

5. Leadber as Data Intermediary

Leadber aggregates publicly available business information and provides it to you as a data intermediary. Leadber does not collect, store, or sell personal data of end consumers. All data accessed through the Service is business contact data intended for B2B use only. You assume full responsibility for how you use, process, and store any data obtained through the Service.

6. Pricing Changes

Big Mouth Marketing Pte Ltd reserves the right to adjust pricing, plan credits, and feature availability at any time without prior notice. Price changes take effect at the start of the next billing cycle. Continued use of the Service following a price change constitutes acceptance of the new pricing.

7. Opt-Out Mechanism

Leadber automatically processes STOP/UNSUBSCRIBE replies received via WhatsApp. When a lead replies with STOP, their status is permanently set to OPTED_OUT and no further messages will be sent. You are prohibited from manually overriding this status to re-contact opted-out leads.

8. Intellectual Property

Leadber and its original content, features, and functionality are owned by Big Mouth Marketing Pte Ltd and protected by international copyright, trademark, and other intellectual property laws.

9. Disclaimer of Warranties

The Service is provided "AS IS" without warranty of any kind. Leadber does not warrant that scraped data is accurate, complete, or up to date. You use scraped data at your own risk and are responsible for verifying its accuracy before outreach.

10. Limitation of Liability

To the maximum extent permitted by law, Leadber shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including any fines or penalties you incur for non-compliance with applicable laws.

Limitation of Liability — Compliance

Leadber provides tools for B2B outreach only. Users are solely responsible for ensuring their outreach activities comply with all applicable laws including but not limited to the Personal Data Protection Act (PDPA) and Do Not Call (DNC) Registry provisions. Leadber Pte Ltd accepts no liability for any breaches or violations arising from user outreach activities.

11. Termination

We may terminate or suspend your account immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, third parties, or for any other reason at our sole discretion.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Singapore, without regard to its conflict of law provisions.

13. DNC/PDPA Compliance & Indemnity

By using Leadber's outreach features, you agree that you are solely responsible for compliance with all applicable laws including Do Not Call (DNC) registries, PDPA, GDPR, and any local data protection regulations. Leadber provides tools only and accepts zero liability for how you use them. You indemnify Leadber fully against any claims arising from your outreach activities.

It is your responsibility to:

  • Check all applicable DNC registries before contacting any individual
  • Obtain proper consent where required by local data protection laws
  • Honor all opt-out and unsubscribe requests immediately
  • Maintain records of consent as required by applicable regulations
  • Comply with PDPA (Singapore), GDPR (EU), CAN-SPAM (US), and equivalent local laws

14. Refund Policy

All Sales Are Final — No Refunds

All purchases made on Leadber.com are final and non-refundable. Big Mouth Marketing Pte Ltd does not offer refunds, exchanges, or credits under any circumstances, including but not limited to unused credits, partial billing periods, plan downgrades, or voluntary account cancellations. By completing a purchase, you expressly acknowledge and agree to this no-refund policy. Nothing in this policy limits any rights you may have under applicable consumer protection laws that cannot be excluded by contract.

Designed for B2B. Compliance is Your Responsibility.

Leadber is designed exclusively for Business-to-Business (B2B) outreach using publicly available business information. While Business Contact Information (BCI) may be treated differently from personal data under Singapore's PDPA, compliance obligations vary by jurisdiction and use case.

What you should do:

  • Only contact businesses relevant to your products/services
  • Check the Singapore DNC Registry before calling or texting
  • Ensure your outreach is professional and business-relevant
  • Consult a legal professional if you are unsure of your obligations
  • Review PDPC guidelines applicable to your business
